Cabinda Gulf Oil Company Limited – Angola Branch lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court order declaring its appeal in a labour case lapsed for non-payment of court costs, invoking the rights of appeal, to effective judicial protection and to a fair trial. The Court allowed the appeal, holding that declaring an appeal lapsed for late payment or non-payment of costs is a disproportionate sanction, and returned the case to the Supreme Court for its decision to be revised.
