Cabinda Gulf Oil Company, Limited brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment upholding the nullity of an employee's dismissal and his reinstatement, because disciplinary proceedings had been initiated by the Human Resources Director without delegated powers, relying on legality and fair trial. The Court dismissed the appeal because breach of a mandatory rule on disciplinary competence entails nullity and the company had taken part in every stage of the proceedings.
