The appellant brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment upholding his conviction for simple intentional homicide, alleging breaches of the presumption of innocence and in dubio pro reo, refusal of requested evidence-gathering and lack of reasoning. The Court dismissed the appeal because the judgment set out factual and legal reasons and it was not for the Constitutional Court, which is not a further court of review, to reassess the ordinary courts' evaluation of evidence.
