The appellant, dismissed by decision of the National Director of Customs, brought an extraordinary appeal on grounds of unconstitutionality against an order of the Rapporteur of the Supreme Court's Full Court and Appeals Division declaring her appeal abandoned although her submissions were filed in time, invoking access to justice and a fair trial. The Court allowed the appeal and declared the decision unconstitutional because the judge upheld it despite a clerical error by the registry, remitting the case.
