The company CLIDOPA, Clínica dos Petróleos e Corpo Diplomático, Lda brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment which, in a civil liability action, reduced the compensation payable to the equivalent of 1.5 million US dollars, alleging an arbitrary and disproportionate decision. The Court dismissed the appeal because the court had weighed the competing interests in setting compensation, and there was no breach of fair trial, private property, legality, proportionality or equality.
