A citizen lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment upholding the dismissal of his action against Banco de Comércio e Indústria (BCI) to unfreeze an account blocked in 1996 over the deposit of forged cheques, invoking a fair trial, the adversarial principle and effective judicial protection. The Court dismissed the appeal, as the lower courts had decided on documentary evidence and the free assessment of evidence, without breaching constitutional rights.
