Two tenants lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment which, in an action for recovery of property, recognised the plaintiff's ownership of a building and ordered its return, invoking effective judicial protection, the adversarial principle and the right to housing. The Court dismissed the appeal, as the plaintiff's ownership was proven, the State had annulled the lease it had granted in error and there was no contract between the appellants and the owner.
