The appellant, an employee dismissed by Banco Angolano de Investimento, lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of the Labour Chamber of the Supreme Court which, although declaring the dismissal null and void, applied the consequences of an unjustified dismissal, with lower compensation. The Court allowed the appeal, holding that the judgment disregarded a mandatory provision of the General Labour Law and infringed the right to a fair trial, the right to fair compensation and the favor laboratoris principle.
