The appellant, whose sentence the Supreme Court had reduced to 4 years' imprisonment, lodged an extraordinary appeal on grounds of unconstitutionality, alleging that his trial took place with an ad hoc Public Prosecution representative, lack of reasoning and breaches of in dubio pro reo, legality and proportionality. The Court dismissed the appeal, since the ad hoc representative issue had not been raised before the Supreme Court and the judgment under appeal was reasoned and did not breach the principles invoked.
