A defendant lodged an extraordinary appeal on grounds of unconstitutionality against the decision of the President of the Benguela Court of Appeal refusing his habeas corpus application and fining him, alleging detention three days beyond the legal limit for being brought before a judge and a restriction of his rights to habeas corpus and appeal. The Court dismissed the appeal because the fine was provided for in the Code of Criminal Procedure and he had not been prevented from appealing.
