A defendant appealed against the order of the President of the Benguela Court of Appeal refusing his habeas corpus application as untimely, alleging that he had been brought before the judge of guarantees about four days after arrest, beyond the 48-hour limit, and invoking legality, equality and the presumption of innocence. The Court dismissed the appeal because the alleged unlawfulness was no longer current, the appellant being in pre-trial detention within the legal time limits and already indicted.
