The appellant, ordered in a property recovery action to recognise a company's ownership of a shop and annexes in a shared yard and to compensate it, lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment upholding that decision. The Court allowed the appeal and remitted the case, holding that disregarding the probative force of the deed and land registration in his favour breached legality, the right to a fair trial and the right to private property.
