The appellant, a civil servant dismissed for forging an educational certificate, lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of the Plenary of the Supreme Court allowing an appeal by the Ministry of Finance, alleging that the Ministry's submissions were signed by someone without authority and that the presumption of innocence, proportionality and the rights of defence and to be heard had been breached. The Court dismissed the appeal, finding no breach of those principles or rights.
