Sociedade Mineira do Chitotolo, Lda. lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court order declaring lapsed, for late submissions, its interlocutory appeal against the refusal of an application to suspend the effects of an administrative act. The Court allowed the appeal and declared the decision unconstitutional, since the submissions had been filed in time and the administrative-procedure rule had been misapplied, breaching access to justice, legality and fair trial.
