A citizen lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of the Full Court and Appeals Court of the Supreme Court upholding the 1999 confiscation of his urban property for prolonged absence from the country, alleging failure to rule on issues, retroactive effect of fundamental rights and reversal of the burden of proof. The Court dismissed the appeal because the appellant had to prove the reasons for his absence and the Court could not reassess evidence.
