A citizen convicted of intentional homicide lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment increasing his sentence, alleging insufficient evidence and breach of his rights of defence and to a fair trial. The Court allowed the appeal, as he had not been notified of the Public Prosecution Service's submission seeking a heavier sentence, in breach of legality, the right of defence, adversarial proceedings and a fair trial, and remitted the case.
