The appellant brought an extraordinary appeal on grounds of unconstitutionality against a new Supreme Court judgment given after an earlier Constitutional Court decision in his favour, alleging disregard of that decision and breaches of non bis in idem, legal certainty and fair trial. The Court dismissed the appeal because annulment of the first judgment did not amount to a second trial and the Supreme Court had complied with the constitutional decision, respecting the adversarial principle and reducing the appellant's punishment.
