The company IMBONDEX – Construções e Materiais de Construção, S.A. lodged an extraordinary appeal on grounds of unconstitutionality against a Luanda Court of Appeal judgment upholding the striking out of its defence, filed out of time, alleging irregular service on a security guard employed by another firm. The Court dismissed the appeal, since the appellant had actual knowledge of the summons and took part in the proceedings without objecting, thereby curing the irregularity.
