A citizen convicted of attempted homicide lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment upholding the conviction, alleging refusal to hear a witness, unequal recording of statements and breach of the adversarial principle, the right of defence, fair trial and the presumption of innocence. The Court dismissed the appeal, since the appeal to the Supreme Court had been limited to sentencing and it was not for the Constitutional Court to reassess the evidence.
