The appellant lodged an extraordinary appeal on grounds of unconstitutionality against the decision of the President of the Benguela Court of Appeal rejecting his habeas corpus application as out of time, alleging a failure to rule on the lawfulness of his arrest and pre-trial detention. As his pre-trial detention had meanwhile been replaced by periodic reporting and he had been released, the Court declared the proceedings terminated as moot.
