Sporting Clube de Benguela appealed against the Supreme Court judgment recognising the possession and surface right of the Cúria Diocesana de Benguela over the Arregaça ground, allowing the club only sporting use, invoking its right of property, by adverse possession, and free economic initiative. The Court dismissed the appeal because the Cúria holds a surface right backed by title and the club's claim concerns the merits, a matter for the ordinary courts.
