Clínica Girassol and one of its doctors lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment which, overturning their acquittal at first instance, held them jointly liable to compensate a patient for failure to provide health care, alleging breach of effective judicial protection, fair process, the duty to give reasons and legality. The Court dismissed the appeal, since the judgment had given objective reasons for civil liability and had given effect to the fundamental right to health.
