A citizen appealed against a judgment of the Full Court and Appeals Court of the Supreme Court which, on an application for review, reversed an earlier decision and recognised a de facto union for property purposes and the allocation of the family home, invoking legality and res judicata. The Court allowed the appeal and held the decision unconstitutional because the review had been admitted and decided although the requirements of Article 771 of the Code of Civil Procedure were unmet.
