A citizen lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment in an action to maintain possession of a property, alleging that her lawyer had not been notified and that the action was time-barred, a matter the court should have raised of its own motion, in breach of legality and the right of defence. The Court dismissed the appeal, as the action had been brought within the one-year limit and fair-process guarantees had been respected.
