The appellants, who were claiming allowances from the Municipal Health Directorate of the Cachiungo Municipal Administration, lodged an extraordinary appeal on grounds of unconstitutionality against a Benguela Court of Appeal judgment dismissing the case for lack of subject-matter jurisdiction, arguing that their employment was public and subject to administrative litigation. The Court dismissed the appeal: the judgment breached neither the Constitution nor the law, and the merits, not yet examined by the ordinary courts, fell outside its remit.
