The Public Prosecution Service at the Criminal Chamber of the Supreme Court lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of that Court which, in embezzlement proceedings, heard an appeal against a committal order that by law could not be appealed and declared the prosecution time-barred. The Court allowed the appeal, holding that the judgment infringed the principles of the democratic rule of law, legality, and access to justice and effective judicial protection, and returned the case for trial.
