A defendant in pre-trial detention, whose habeas corpus had been granted by the President of the Luanda Court of Appeal, lodged an extraordinary appeal on grounds of unconstitutionality against the official letter by which that President suspended execution of the release order, citing a Supreme Court judgment on an appeal by co-defendants. The Court dismissed the appeal for lack of a proper object, since the letter was a mere procedural act and the judicial decision was favourable to him; he may challenge it before the issuing court.
