A citizen in pre-trial detention lodged an extraordinary appeal on grounds of unconstitutionality against the order of the President of the Luanda Court of Appeal refusing her habeas corpus application, alleging that the maximum period of pre-trial detention without a final conviction had been exceeded. The Court allowed the appeal, as keeping the measure beyond the statutory limits breached legality, the presumption of innocence and the ban on penalties of unlimited duration, and ordered her immediate release.
