Two citizens appealed against the order of the President of the Court of Auditors refusing to admit their ordinary appeal for non-payment of fees of which they said they had not been notified, invoking effective judicial protection, fair trial and the right of appeal. The Court allowed the appeal, holding that advance fees could be paid or collected at the end and that automatic rejection breached those guarantees, and remitted the case for the appeal to be admitted.
