Three citizens held in pre-trial detention brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment that, declaring itself without subject-matter jurisdiction, declined to hear their habeas corpus application. They invoked the rights to habeas corpus, to a defence and to a fair trial. The Court dismissed the appeal, holding that the declaration of lack of jurisdiction does not breach the Constitution and that the competent court is the Supreme Military Court.
