Four citizens lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment that had declined, for lack of subject-matter jurisdiction, to hear their habeas corpus application based on excessive pre-trial detention. The Court dismissed the appeal, holding that under Articles 68 and 176 of the Constitution the Supreme Military Court had jurisdiction to hear the application, so the decision under appeal neither breached the provisions invoked nor amounted to a denial of justice.
