The appellant, the defendant in an eviction action, lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court order declaring her appeal abandoned for non-payment of court fees and a fine. The Court found that the payment notice had been served on her former lawyer, who had renounced the mandate, and allowed the appeal, as this nullity undermined the rights of appeal and effective judicial protection, returning the case to the Supreme Court.
