A defendant in pre-trial detention lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment refusing his habeas corpus application, alleging that pre-trial detention time limits had been exceeded because the indictment was not served in time, and breach of the presumption of innocence, freedom of movement and a fair trial. The Court declared the proceedings terminated as moot because the appellant had meanwhile been released on an identity and residence undertaking.
