The company Bricomil – Construção Civil e Obras Públicas, SA appealed against the Supreme Court judgment which, in an action for the return of a construction site, upheld an objection of lack of legal representation and dismissed the case on procedural grounds, invoking fair trial and legality. The Court found no breach of those principles, as the power of attorney was irregular and the appellant, notified to remedy the defect, had not done so, and ordered it to pay costs.
