The appellant brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment rejecting his habeas corpus application, arguing that his pre-trial detention was excessive and not based on sufficient evidence, in breach of Article 68 of the Constitution. The Court established of its own motion that he had meanwhile been acquitted at first instance, so it held that there was no point in hearing the appeal, which had become devoid of purpose.
