Two individuals sentenced by the Luanda Provincial Court to 3 years' imprisonment lodged an extraordinary appeal on grounds of unconstitutionality directly against the first-instance judgment, invoking the rights to a fair trial and to adversarial proceedings regarding the drafting of the questions of fact. The Court held that it lacked jurisdiction to hear the appeal, since ordinary remedies in the ordinary courts had not been exhausted and an appeal first lay to the Supreme Court.
