A foreign national appealed against the Supreme Court judgment refusing him habeas corpus, alleging that he had been arrested outside flagrante delicto and without a warrant, in breach of Articles 63 and 64 of the Constitution, and that the Supreme Court had examined only the legality, not the constitutionality, of the arrest. As the appellant had meanwhile been granted provisional release on bail, the Court found the case moot and closed the proceedings.
