A worker lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of the Labour Chamber of the Supreme Court which, finding her dismissal unjustified, ordered the employer to pay compensation instead of reinstating her, arguing that the lack of disciplinary proceedings made the dismissal null and invoking the principle of legality and the right to a fair trial. In its reasoning, the Court found no breach of those rights.
