The appellant, convicted at first instance and held in pre-trial detention pending an appeal with suspensive effect, brought an extraordinary appeal on grounds of unconstitutionality against an order of the President of the Supreme Court upholding the refusal of his habeas corpus application, invoking the presumption of innocence, in dubio pro reo and legality. The Court dismissed the appeal because the case fell within none of the statutory grounds for habeas corpus, a remedy reserved for manifest unlawfulness.
