A citizen lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment which, in an action for rendering of accounts against the Viana Municipal Administration, found the first-instance court to lack subject-matter jurisdiction and dismissed the case, invoking effective judicial protection and a fair trial. The Court allowed the appeal, as the Supreme Court had not indicated the competent chamber or the applicable rule, breaching the right to a fair trial in accordance with the law.
