The company Rita Projectos, Limitada brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court order declaring its civil appeal abandoned for alleged late payment of court costs and closing the proceedings. The Court allowed the appeal and declared the decision unconstitutional for breach of the right of access to justice and effective judicial protection, since the costs had been paid 117 days before the order, while finding no breach of the right of defence.
