Judgment No. 828/2023

ENSA – Seguros de Angola, S.A. lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment dismissing its appeal, invoking the rights to adversarial proceedings, access to the courts, effective judicial protection and a fair trial. The Court dismissed the appeal, since the appellant had not shown how the judgment contravened the Constitution, had effectively exercised its rights of reply and defence, and the decision rested on a contradiction between the claim and the cause of action.
