The appellant lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment which, in an action to recover a property in Huíla, upheld the plea of res judicata because an earlier decision had recognised the MPLA Municipal Committee as usufructuary of the same property. He alleged breach of the principles of legality, equality and fair trial. The Court dismissed the appeal, holding that, res judicata being established, the judgment did not infringe constitutional principles, rights or guarantees.
