The appellant, a former Ministry of Education employee claiming unpaid salary in court, lodged an extraordinary appeal on grounds of unconstitutionality against an order of the Rapporteur of the Luanda Court of Appeal declaring his appeal lapsed for non-payment of court-fee advances. The Court allowed the appeal and remitted the case for the appeal to be admitted, holding that declaring it lapsed on formal grounds breached access to law and effective judicial protection and the right of appeal.
