A convicted citizen lodged an extraordinary appeal on grounds of unconstitutionality against the order of the President of the Supreme Court refusing his habeas corpus application, alleging excessive pre-trial detention because the suspensive effect of his extraordinary appeal for review had been disregarded. He invoked the rule of law, legality and fair trial. The Court dismissed the appeal because his conviction had become final, so he was serving a sentence rather than being held in pre-trial detention.
